Terms of Use

Effective: April 2026

These Terms of Use govern your access to and use of AllergyScan, operated by Gibson Wade. By using AllergyScan, you agree to these terms. If you do not agree, you must not use the service.

Allergen Information Disclaimer

Important food safety notice. Allergen information on AllergyScan is entered by restaurant operators. AllergyScan does not independently verify the accuracy, completeness, or currency of this information. Menus and ingredients change without notice, and cross-contamination risks may not be reflected in the data displayed.

Always confirm allergen information directly with restaurant staff before ordering, particularly if you have a severe allergy or are at risk of anaphylaxis. Do not rely solely on this platform as your only safety check.

AllergyScan accepts no liability for any allergic reaction, adverse health event, or loss arising from reliance on information displayed on this platform.

Service Description

AllergyScan is a two-sided platform that allows restaurant operators to publish allergen information for their menus, and allows customers to filter that information based on a personal allergen profile. The service is provided as a convenience tool — it does not replace professional dietary or medical advice.

Restaurant Operator Responsibilities

By registering a restaurant on AllergyScan, you agree to:

  • Provide accurate and current allergen information for all menu items you list
  • Update your menu data promptly whenever dishes, ingredients, or preparation methods change
  • Not misrepresent or omit allergen information, whether intentionally or through neglect
  • Understand that customers may make dining decisions based on the information you provide

You are solely responsible for the accuracy of the data you enter. AllergyScan is a publishing tool — the legal and moral responsibility for allergen accuracy remains with the restaurant.

Customer Account Responsibilities

  • You are responsible for the security of your account credentials. Do not share your password.
  • You must ensure your allergen profile is accurate and up to date.
  • You must not use the service for any unlawful purpose or in any way that could harm others.

Prohibited Uses

You may not:

  • Scrape or systematically download data from the platform without written permission
  • Impersonate another person or entity
  • Upload false, misleading, or malicious content
  • Attempt to circumvent security controls or access data you are not authorised to view
  • Use the service to transmit spam or unsolicited communications

Intellectual Property

The AllergyScan platform, including its design, code, and branding, is owned by Gibson Wade. Restaurant operators retain ownership of the content they upload. By uploading content, you grant AllergyScan a non-exclusive licence to display that content to users of the platform.

Limitation of Liability

To the fullest extent permitted by applicable law, AllergyScan and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Any allergic reaction or adverse health outcome arising from use of or reliance on the service
  • Loss of data, revenue, or business opportunity
  • Errors or inaccuracies in restaurant-provided menu or allergen data

Our total liability for any claim arising out of these terms shall not exceed the amount you paid to us in the twelve months preceding the claim (or £50 if no payment was made).

Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in conduct we deem harmful to the platform or its users. You may delete your account at any time by contacting us.

Changes to These Terms

We may update these terms at any time. We will update the effective date at the top of this page. Your continued use of the service after changes are published constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
